Challenges and Opportunities in Somali Law Post-Conflict Context
Abstract
Somalia has experienced significant challenges in establishing a stable legal framework post-conflict, with ongoing issues of governance and social cohesion. This study employed semi-structured interviews and thematic analysis to gather insights from legal practitioners and community leaders in Somalia. Findings indicate a high degree of resistance to new legal initiatives, particularly those related to property rights and inheritance laws. However, there is also evidence of growing interest in digitalizing legal documentation and using technology for judicial processes. The challenges identified are largely rooted in cultural norms and traditional practices, while the opportunities lie in leveraging technological advancements and international support. A phased approach to reform should prioritise addressing cultural resistance through dialogue and education, alongside the integration of digital tools for legal administration.
