Challenges and Opportunities in Post-Conflict Law: A Mixed Methods Assessment in South Sudan

Abstract

Post-conflict South Sudan faces significant legal challenges in establishing a stable and effective legal framework. A mixed methods approach combining qualitative interviews with quantitative survey data to evaluate legal practices and perceptions among key stakeholders. Survey results show a significant reliance on traditional dispute resolution mechanisms (72%) despite the presence of formal legal institutions, indicating a need for integration rather than replacement. The mixed methods study highlights the importance of integrating traditional justice systems with formal legal frameworks to enhance legal efficacy and acceptance. Policy recommendations include strengthening interagency cooperation between traditional leaders and government officials to facilitate smoother transitions and ensure comprehensive legal coverage.
