Comparative Frameworks of Competition Law in East African Community Countries: A Focus on Congo Republic

Abstract

This study examines the competition law frameworks in East African Community (EAC) countries with a focus on the Republic of Congo. A comparative legal analysis approach was employed, involving a review of national competition laws, regulations, case studies, and expert opinions from the selected countries. Secondary data sources were primarily used to ensure objectivity and consistency across jurisdictions. The findings indicate significant variations in the application of anti-trust provisions among EAC member states, with Congo Republic having relatively weaker enforcement mechanisms compared to other EAC countries. This study concludes that while there are commonalities in competition law structures within the EAC region, each country has unique challenges and opportunities for enhancing its legal framework. Recommendations include strengthening regulatory bodies, harmonizing laws across borders, and increasing public awareness of anti-trust legislation to improve compliance and enforcement effectiveness.
