Traditional Remedies and Their Impact on Access to Justice in Côte d'Ivoire: A Comparative Analysis
Abstract
Traditional remedies play a significant role in dispute resolution within Côte d'Ivoire's traditional legal system. A comparative analysis of traditional remedies versus formal courts was conducted, focusing on data from recent court cases and interviews with local practitioners. Traditional dispute resolution mechanisms are utilised in approximately 40% of cases involving disputes over land rights, indicating their substantial role despite the prevalence of formal legal systems. The traditional legal system offers a viable alternative for marginalized communities seeking justice but faces challenges in terms of recognition and integration into modern legal frameworks. Efforts should be made to enhance the capacity of traditional dispute resolution mechanisms and promote their acceptance within mainstream judicial processes.
